The present appeal under Order XXI Rule 58 read with Section 151 of the CPC seeks following prayers:- "(i) Allow the present appeal;
(ii) Set-aside impugned order dated 02.12.2025 to the extent dismissing objections of the appellant under Section 47 C.P.C. and consequently allow the objections of the appellant;
(iii) pass any other or further orders or directions as this Hon'ble Court may deem fit and proper in view of the facts and circumstances of the case, in the interest of justice."

Learned counsel appearing on behalf of the appellant seeks leave to withdraw the present appeal with liberty to initiate appropriate proceedings in accordance with law with respect to judgment dated 21.10.2019. 4.
