% 15.02.2024 CM APPL. 11938/2023 This is an application filed by the applicants / respondents seeking condonation of delay of 25 days in filing the counter-affidavit. For the reasons stated in the application, same is allowed. Counteraffidavit is taken on record. Application stands disposed of.

This petition has been filed by the petitioner with the following prayers:

following orders:- a) Issue the writ of mandamus or any other appropriate writ against the respondents and in favour of the petitioner directing them to grant the benefits of the MACP in the appropriate pay scale of the Inspector i.e. 9300-34800 (Grade pay 4600), level 7, Index -8, Rs. 55,200/- from the date of completion of 30 years of continuous service to the petitioner alongwith all the arrears and issue revised pension PPO since - 2006; and/ or b) May pass any other order/ orders as this Hon'ble Court may think fit and proper in the present facts and circumstances of the case."

In effect, the petitioner is seeking the benefit of MACP Scheme. It is a conceded position that MACP Scheme was introduced w.e.f September 1, 2008. The petitioner had retired on November 30, 1996, i.e., much before the MACP Scheme was introduced. The petitioner cannot be granted the relief prayed for.

The petition is dismissed.
