Issue notice.

1.1 Mr Prashant Manchanda, learned Additional Standing Counsel, who appears on behalf of the non-applicant/appellants, accepts notice. 2.

Mr Manchanda, on instructions, says that he does not wish to file a reply as a similar issue has been decided by this court in a bunch of matters via judgment dated 26.02.2024.

This application has been moved on behalf of respondent no.1 i.e., Prabhat Mutreja.

3.1 The applicant/respondent no.1/Prabhat Mutreja is the landlord of the subject premises. The subject premises were, concededly, given on lease to respondent no.2 i.e., M/s Adharv Enterprises. 4.

It is not disputed that respondent no.2/M/s Adharv Enterprises had obtained the license for running liquor vend in the subject premises. 5.

As indicated right at the beginning, similar applications were filed in a bunch of Letters Patent Appeals. The Letters Patent Appeals were disposed of by the court via an order and judgment dated 26.02.2024. The lead matter in which the aforementioned order was passed is CM Appl. no.7995/2024 in LPA 193/2023.

This application is, thus, disposed of, in terms of the said order. The directions contained therein will apply mutatis mutandis to the above applicant/respondent no.1/Prabhat Mutreja.

Given the order that we have passed in CM Appl. no.14553/2024, according to Mr Manchanda, the appeal can be closed, keeping the questions of law open.

7.1 It is ordered accordingly.

The date already fixed in the matter i.e., 30.05.2024 shall stand closed.
