Mr. Krish Kalra, learned counsel for the ex-management of the respondent, submits that Corporate Insolvency Resolution Process ["CIRP"] have been instituted against the respondent and a moratorium has been imposed by order of the National Company Law Tribunal dated 22.04.2024.

Mr. Kalra states that, although the respondent has filed an appeal against the order admitting CIRP proceedings before the National Company Law Appellate Tribunal, the moratorium remains in place. 3.

In view of the above, learned counsel for the petitioner, seeks permission to withdraw the present petition with liberty to take appropriate remedies, as may be available in law. 4.
