Pursuant to the last order, the respondent no. 1 has filed an affidavit clearly stating therein that they are amenable to the jurisdiction of Armed Forces Tribunal (AFT) and would not raise any objection qua the maintainability of the present petition before the Tribunal. 2.
In the light of this affidavit filed by respondent no. 1, learned counsel for the petitioner prays that the present petition be transferred to the AFT. 3.
In view of the aforesaid stand taken by the parties, the petition is transferred to the AFT, Principal Bench, Delhi and directed to be listed before the learned Registrar of the AFT on 02.09.2024. The Registry is directed to forthwith remit the record of the present petition to the AFT. 4.
