By way of present bail application, the applicant seeks regular bail in FIR No. 410/2018 registered under Sections 406/420/409/174A IPC originally at Police Station Dwarka North, Delhi, later transferred to PS EOW, Mandir Marg, Delhi.

Learned counsel for the applicant states that the applicant is in custody since 07.07.2023 and that a dispute had arisen between the applicant and the complainant, who was one of the Directors in the company along with the applicant. It is stated that the parties have been able to amicably resolve their disputes. Learned counsel further confirms that the chargesheet stands filed. It is stated that the applicant will be residing with his wife at the said address.

Learned APP for the State submits that though there are complaints received from the home-buyers against the company/officials, however, the same are not part of the present investigation and are being separately inquired into. He further states on instructions that the address of the applicant, as mentioned in the affidavit, has also been verified. 5.
Considering the totality of the facts and circumstances and the fact that the parties have arrived at an amicable settlement as well as the period of custody undergone by the applicant, it is directed that the applicant be released on regular bail subject to his furnishing a personal bond in the sum of Rs.50,000/- with one surety of the like amount to the satisfaction of the concerned Jail Superintendent/concerned Court/Duty Judicial Magistrate First Class and subject to the following further conditions :- i) The applicant shall not leave the NCR without prior permission of the concerned Court.
ii) The applicant shall provide his mobile number to the Investigating Officer on which he will remain available during the pendency of the trial. iii) In case of change of residential address or contact details, the applicant shall promptly inform the same to the concerned Investigating Officer as well as to the concerned Court.
iv) The applicant shall not directly/indirectly try to get in touch with the complainant or any other prosecution witnesses or tamper with the evidence. v) The applicant shall regularly appear before the concerned Court during the pendency of the trial.

The bail application is disposed of in the above terms along with pending applications.
