The present writ petition has been filed seeking a direction to the respondent no.1/MCD to demolish the unauthorized construction being carried out by the owners of property bearing no. L-69, Kalkaji, New Delhi110019 (hereinafter the 'subject property'). 2.

Counsel appearing on behalf of the petitioner submits that the petitioner is an immediate neighbour of the subject property. 3.

Counsel appearing on behalf of the respondent no.1/MCD, on advance notice, submits that the aforesaid construction has been carried out W.P.(C) 4964/2026 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. by the owner/ occupier of the subject property, after obtaining a duly approved sanction plan.

To be noted, owner/ occupier of the subject property has not been impleaded as a party in the present petition. 5.

In view thereof, counsel appearing on behalf of the petitioner seeks to withdraw the present petition, with liberty to file a fresh petition, if necessary, with better particulars and impleading necessary parties. 6.

The present writ petition is dismissed as withdrawn with the aforesaid liberty.
