This petition was filed seeking following directions: "a) Issue a writ in the nature of Certiorari, or any other appropriate writ, order or direction, thereby, quashing the Advertisement dated 03.03.2023 issued by the Respondent for appointment to the post of Assistant General Manager (Civil Engineering / Electrical Mechanical) on transfer through deputation basis in the Food Corporation of India. b) Issue a writ in the nature of Mandamus, or any other appropriate writ, order or direction, thereby, directing the respondent to consider the Petitioner Nos.

In the counter, respondent pleaded:- "The instant Writ Petition is not maintainable and deserves to be dismissed in limini as no cause of action ever arose in favour of the Petitioners. A statement on behalf of the Respondent has already been recorded by the Hon‟ble Court that that the promotional avenues of the Petitioners, who are aspiring for promotions to the posts on which the Respondent is seeking to appoint persons from outside on deputation basis, pursuant to the impugned advertisement dated 03.03.2023, will not be adversely impacted and as and when their turn for promotion comes, the vacancies will be available for them.
It is further submitted that even the first batch of the Petitioners, as per the categorization given in the writ petition, will not be adversely affected on account of people being appointed on deputation basis. It is further submitted that the Respondent is fully entitled, under Regulation 7(3)(a) of the FCI Staff Regulations Act, 1971, to make appointment to any post in the Corporation by deputation of suitable officers from the Central or from any State Government or from any public sector undertaking."

Learned counsel for the petitioner states that in view of the pleadings in the counter filed by FCI, no grievance survives for pursuing this petition. 4.
