The present writ petition has been filed seeking the following reliefs: "a) Directing the respondent no. 1 authorities to conduct a structural stability test and technical quality inspection of the building and basement constructed at property No. 17/27, East Punjabi Bagh, New Delhi through qualified structural engineers and take the appropriate action for sealing, including demolition, if the construction is found unsafe or in violation of building bye-laws or deviation in if any site plan sanctioned.

b) Pass the directions to the respondent no. 1 to initiate the legal proceedings against the respondent no. 7, occupier, builder at property No. 17/27, East Punjabi Bagh, New Delhi area approximately 280 square yards for raising the illegal and unauthorized construction in violation of building bye-laws or deviation in if any site plan sanctioned."

It is an admitted position that there is an ongoing civil dispute between the petitioner and private respondent no.7 being CS(OS) 203/2019 and RFA(OS) 40/2020, which is pending before this Court, in relation to the same property 3.

Accordingly, counsel appearing on behalf of the petitioner seeks to withdraw the present writ petition in order to approach the civil Court. 4.

The present writ petition is dismissed as withdrawn. 5.

Pending applications also stand disposed of.
