The instant bail application under Section 439 of the Code of Criminal Procedure, 1973 ('Cr.P.C') has been filed on behalf of the petitioner seeking extension of interim bail granted to him for a period of month vide order dated 24.01.2024 passed by this Court, in case arising out of FIR bearing No.760/2021, registered at Police Station New Usmanpur, Delhi for offences punishable under Sections 20/29 of the Narcotic Drugs and Psychotropic Substances, Act 1985 ('NDPS Act'). 4.
Issue Notice, Mr. Sanjeev Bhandari, learned ASC accepts notice on behalf of the State.

Learned Counsel for the applicant submits that the applicant was granted interim bail vide order dated 24.01.2024 for a period of one month The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. on the ground that the applicant's wife had to undergo surgery on 29.01.2024. Thereafter, the applicant had further applied for extension of his interim bail and the same was allowed vide order dated 23.02.2024 by this Court. It is argued that the applicant is now seeking further extension of his interim bail on the ground that his wife is suffering from post-surgery infection and the documents of the same have been placed on record. It is submitted that the applicant is the only male member in the family and has three minor children and that he will be required to take care of his wife during further course of treatment. In these circumstances, it is prayed that the applicant be granted further extension of interim bail for a period of one month.

Learned ASC for the State opposes the present bail application, however, it is submitted on instructions from the IO that the medical reports filed by the applicant have been verified.

Considering the overall facts and circumstances of the case, and the fact that the applicant's wife is suffering from post-surgery infection and as per the medical report filed on record, applicant's wife may require another surgical intervention, the interim bail granted to the applicant vide order dated 24.01.2024 stands extended further for a period of one month i.e., till 22.04.2023 on the same terms and conditions.

In view of the above, the present application stands disposed of. 9.
