Petitioner is complainant before the Real Estate Regulatory Authority, NCT of Delhi (RERA) and is aggrieved by order dated 12.03.2024, passed by said authority.

When this petition was entertained on 27.03.2024, the proceedings before RERA were directed to be kept in abeyance till further orders.

Now an application has been moved by the petitioner/complainant praying therein that since respondent No.2 has already filed a reply before RERA but in view of the order passed by this Court, said Authority is not in a position to proceed any further CM(M) 2210/2024 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. with respect to its complaint, the order be vacated. 4.
It is also submitted by the learned counsel for the petitioner that he may be permitted to withdraw the present petition with liberty to file appropriate rejoinder to such reply filed by respondent No.2. 5.
Learned counsel for respondent No.1 and learned counsel for respondent No.2 have also joined the proceedings through video conferencing.

During course of the proceedings, when asked, learned counsel for respondent No.2 admitted that he had already filed a reply before RERA.

In view of the above, the main petition has also been taken up for disposal.

In view of the aforesaid statement made by the learned counsel for the petitioner, the present petition is disposed of as not pressed. However, the petitioner would be at liberty to file rejoinder, if any, before said Authority.

It is, however, made clear that this Court has not given any observation with respect to the merit of the claim of the complaint. 10.
It is expected that since the matter has already got delayed considerably, said Authority would take up the matter and would make best endeavour to dispose of the same as expeditiously as possible. 11.
The next date fixed before this Court i.e. 29.11.2024 is cancelled.
