CRL.M.C. 1341/2020 Petitioners filed this petition under Section 482 Criminal Procedure Code for quashing of the FIR No.80/2019 under Section 323/341/506/34 Indian Penal Code registered at police station Kanjhawla, Delhi against them and the proceedings emanating therefrom.
It is stated both the petitioners and the complainant are neighbours and have settled their differences and have entered into a compromise deed dated 26.02.2020 and are left with no grievance against each other.
The complainant/respondent No.2 is present along with learned counsel and has been duly identified by the Investigating Officer, states that matter has been settled with the petitioners. The affidavit of respondent No.2 is at pages No.26-27 and he has no objection if the FIR is quashed against the petitioners.
The learned APP for the State has also no objection, if this petition is allowed. Considering the above settlement between the parties, there is no justification to proceed with the criminal case. Accordingly, the FIR No.80/2019 registered at police station Kanjhawala, Delhi and all proceedings emanating therefrom are hereby quashed.
In view of above, the petition is allowed. Order dasti. YOGESH KHANNA, J.
