The petitioner has approached this Court for a direction upon the respondent - Central Public Works Department ["CPWD"] to pay family pension to the petitioner, who claims to be the widow of Mr. Top Bahadur, a retired employee of CPWD.

At the very outset, Mr. Kalyan Babu Singh, learned counsel for the respondent - CPWD, submits that the petitioner has not made any representation for this purpose to the department itself. In view of this submission, the respondent is directed to treat the writ petition as a representation. If any further information or documents are required, it may call for the same from the petitioner within the next two weeks. 3.

The representation will be disposed of within eight weeks thereafter.

the order passed is adverse to the petitioner, she may agitate her grievances at that stage before the appropriate forum. This order is not intended to imply that this Court would entertain such a challenge, as I am prima facie of the view that the Central Administrative Tribunal would have jurisdiction.
