CORAM:

HON'BLE MR. JUSTICE SANJEEV NARULA

O R D E R

% 19.05.2025 1.

The present application seeks interim bail for a period of 6 weeks in proceedings arising from FIR No. 922/2022 registered under Sections 365/201/120B/302 of the Indian Penal Code, 1860 at P.S. Shahbad Dairy on account of medical condition of the Applicant's spouse. 2.

On 25th March, 2025, when Mr. Amit Ahlawat, APP for the State, pointed out that medical record annexed with the application did not disclose any emergent need for Applicant to be released on bail, counsel for the Applicant sought time to take instructions and produce the relevant record. 3.

Today, at the outset, counsel for the Petitioner submits that since there is no male member in the family, the Applicant's spouse has not been examined by a doctor and therefore, there are no medical record available. 4.

The Court has considered the aforenoted contentions. The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. The Order is downloaded from the DHC Server on 30/06/2025 at 23:53:18

5.

In the latest medical record dated 9th January, 2025 annexed with the application, the doctor has stated that he is not able to comment upon the severity of the illness of the patient as she did not herself get examination done as per the records. Only her medical history has been noted. In such circumstances and in absence of any medical record, the application before the Court is without a valid cause of action and is devoid of merits. 6.

Accordingly, the present application is dismissed. SANJEEV NARULA, J MAY 19, 2025/ab The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. The Order is downloaded from the DHC Server on 30/06/2025 at 23:53:18
