Micro, Small and Medium Enterprises Development Act, 2006, learned Single Judge has kept it open to be looked into by the Arbitrator himself, learned counsel for the appellant states that he may be permitted to withdraw the appeal.

Accordingly, the appeal along with pending application is dismissed as withdrawn.

It is needless to say that it will be open to the parties to address the Arbitrator on the issue as to whether the dispute is covered by the aforementioned State statute or not.
