First Bail Application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed on behalf of the Petitioner, Amar Singh Pippal for grant of Regular Bail in FIR No. 184/2024 under Section 419/420/468/471/120B of the Indian Penal Code, 1860 (hereinafter referred to as 'IPC') registered at Police Station Special Cell. 2.
It is submitted that as per the case of the Complainant, Mr. Datar Singh and Mr. Vikas Shokeen in the year 2021, got the contact of coaccused, Amrendra Kumar from one Yogender while he was in Dehradun. He thus, met Amrendra Kumar, who promised to get him an IGL CNG Pump installed in his name. 2, Amit Pandey, approached the Complainants and deceived him by representing themselves as Co-ordinators and Agents of Indraprastha Gas Limited and further represented that they worked in different Departments of IGL. Both the Accused lured the Complainant to part with money from time to time, which was total of Rs.2.39 Crore and was transmitted in the Accounts of Amrendra Kumar and Amit Pandey and some other Accounts, which had been furnished by the two Accused.

It is also the case of the Complainant that while giving these amounts, the two Loan Agreements had been executed to secure the amounts being handed over to Amrendra Kumar and Amit Pandey. The Applicant has sought Bail on the ground that he was not named in the Complaint and has been implicated on the basis of the Discloser Statement of the co-accused. Not a single penny has been transmitted in his Account. He is in judicial custody since 12.09.2024. He is suffering from tuberculosis for which he is taking the medication. He is aged person of 67 years. He is innocent and has submitted that he has clean antecedents and is not likely to temper with the evidence. The Charge-Sheet already stands filed though, it is an initial stage. A prayer is made that he be granted Bail.

Learned Prosecutor has submitted the Status Report, which is taken on record. According to the State, essentially the evidence against the Applicant is that he had initially met with the Complainants along with the two co-accused. There is also a call retrieved from the mobile of Amit Pandey showing the conversation between the Applicant and him, in regard to the money being received by Amit Pandey. It is submitted that the Bail Application has already been dismissed by the learned CMM as well as Sessions Court. The Bail is therefore, opposed. The only case of the Prosecution against the Applicant is essentially on the basis of a Discloser Statement of the co-accused and one call record. 7.
Considering the nature of allegations and his period of custody, the Applicant is admitted to Regular Bail, on the following terms and conditions:
a) The Petitioner/Accused shall furnish a personal bond of Rs.30,000/- and one surety of the like amount, subject to the satisfaction of the learned Trial Court.
b) The Petitioner/Accused shall appear before the Court as and when the matter is taken up for hearing;
c) The Petitioner/Accused shall provide his mobile number/changed mobile number to the IO concerned which shall be kept in working condition at all times;
d) The Petitioner/Accused shall not indulge in any criminal activity and shall not communicate or intimidate the witnesses. e) In case the Petitioner/Accused changes his residential address, the same shall be intimated to learned Trial Court and to the concerned I.O.

The copy of this Order be communicated to the concerned Jail Superintendent, as well as, to the learned Trial Court. 9.
The Petition is disposed of accordingly. Pending Application also stands disposed of.
