Third Bail Application under Sections 439 Cr.P.C./Section 483 BNSS has been filed on behalf of the Applicant/Hardesh Kumar @ Hunny for grant of regular Bail in FIR No. 1169/2023 under Sections 304B/498A/34 IPC at PS Burari.

It is submitted in the Application that the Applicant got married to the deceased, Jyoti on 08.02.2017 and two daughters were born from their wedlock. The deceased committed suicide by hanging herself on 23.09.2023. On the Complaint of Sh. Rajender Prashad, father of the deceased, FIR No. 1169/2023 dated 25.09.2023 was registered at P.S. Burari under Sections 304B/498A/34 IPC. The Applicant was arrested on The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

It is submitted that the allegations made of alleged dowry demands are vague and are not specific; no date or detail of the alleged demand has been mentioned in the Complaint or otherwise. The statement of material witnesses, i.e. parents, brother, mediator and aunt of the deceased has already been recorded. No fruitful purpose would be served in keeping the accused in jail.

His earlier Bail Application under Section 439 Cr.P.C. filed before learned ASJ has been dismissed on 18.03.2025. 5.
It is therefore submitted he be granted Bail. 6.
The Status Report has been filed wherein it has been submitted that there are 33 prosecution witnesses in main Chargesheet and 04 Prosecution Witnesses in supplementary out of which, 06 witnesses have been recorded. 7.

It is a case of alleged dowry harassment leading to abetement to suicide. All the public witnesses have already been recorded. The allegations of dowry, harassment, abetment to suicide, the allegations of the alleged dowry demand are claimed to be vague and lacking details. The accused is in judicial custody since 27.09.2023.

Considering the number of prosecution witnesses, the trial is likely to take long. In the circumstances, the accused is granted Regular Bail, on the following terms and conditions:
a) The Petitioner/accused shall furnish a personal bond of Rs.35,000/- and one surety of the like amount, subject to the satisfaction of the learned Trial Court;
b) The Petitioner/accused shall appear before the Court as and The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
when the matter is taken up for hearing;
c) The Petitioner/accused shall provide his mobile number/changed mobile number to the IO concerned which shall be kept in working condition at all times;
d) The Petitioner/accused shall not indulge in any criminal activity and shall not communicate or intimidate the witnesses; e) In case the Petitioner/accused changes their residential address, the same shall be intimated to learned Trial Court and to the concerned I.O.

The copy of this Order be communicated to the concerned Jail Superintendent as well as to the learned Trial Court. 11.
