% 20.01.2016 Learned counsel for the defendant has tendered in court an email communication dated 18.07.2015 along with copy of the letter of the even date issued by the defendant to the learned counsel for the plaintiff. Learned counsel submits that the defendant is ready and willing to suffer a decree of injunction as sought by the plaintiff, provided the plaintiff gives up its claim for damages and costs. Learned counsel for the plaintiff, on instructions, is agreeable to this offer made by the defendant. Accordingly, the present suit is decreed in terms of prayer (i) of the plaint.
