The present petition under Section 482 of the CrPC read with Article 227 of Constitution of India seeks following prayers:- "In view, of the aforesaid facts and circumstances, in the present petition under section 482 CRPC read with Article 227 of the Constitution of India, it is graciously prayed that this Hon'ble Court may please: I. To call the Trial Court record (TCR);
II. To set aside the impugned observation/ order dated 08.12.2023 in the matter titled "Pankaj Arora Vs. Ranjeeta Virk Arora" passed by Ms. Neha Paliwal Sharma, ASJ-05 (W) Tis Hazari Court, Delhi, in appeal/ CA no. 108/2021 u/s 29 of PWDC Act, 2005 wherein it has been wrongly observed that by not complying with the summoning conditional order dated 06.10.2021 the respondent will not get any direct benefit; and also III. To direct the respondent to comply with the conditional summoning order/ direction dated 06.10.2021 thereof of Sh. Dharmesh Sharma, Principal District and Sessions Judge (West), Tis Hazari Court, Delhi, in the same appeal no. 108/2021 u/s 29 of PWDC Act, 2005 before the appeal is to be adjudicated;
IV. Pass any other appropriate order, or direction with this Hon'ble court may deem fit for the proper according to the circumstances and facts in favor of the petitioner and against the respondents in the interest of justice."

Learned counsel appearing on behalf of the petitioners seeks leave to withdraw the present petition with liberty to pursue his proceedings pending before the concerned Execution Court.
