The present petition under Articles 226 and 227 of the Constitution of India, 1950 seeks the following prayers: - "[a] pass an order as to issuance of a writ of certiorari or any other writ, thereby quashing/ modifying the impugned ex - parted a judgment dated 09.01.2023 which has been passed by learned Addl. District & Sessions Judge, POLC - V, RACC, New Delhi in LC no: - 01/2022 titled as Sh. Devi Prasad Shukl Versus Shri Shwetamber Sthankwasi Jain Sabha (Regd.).
[b] issue a declaration forth with that the afore mentioned passed impugned an ex - parted judgment passed by learned POLC against the petitioner is illegal, invalid, and void- ab- anitio. [c] issue rule nisi in terms of prayers (a) to (b) mentioned here in above.
