By way of the present application, the applicant seeks grant of regular bail in case arising out of FIR bearing no. 249/2022, registered at Police Station Mundka, Delhi, for the commission of offence punishable under Sections 323/354(D)/376/313/506 of the Indian Penal Code, 1860 (hereafter 'IPC'), and Section 6 of Protection of Children from Sexual Offences Act, 2012 (hereafter 'POCSO Act').

At the outset, this Court notes that the applicant herein was granted bail by the learned Trial Court vide order dated 11.05.2022. However, his bail has been cancelled vide order dated 04.04.2026, since he had violated the specific condition that he will not visit the place of the complainant, will The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

It is not the case of respondent no. 2 that the applicant herein is not attending the trial proceedings before the learned Trial Court. It is also not stated that the applicant has tried to influence the witnesses or tamper with the evidence. It is stated that the trial is at the stage of cross examination of the complainant and the matter has been deferred, since the complainant has not been appearing before the learned Trial Court for the last two occasions. The learned counsel appearing for respondent no. 2 also states that an FIR bearing No. 810/2023, registered at Police Station Mundka, Delhi, for the offence punishable under Section 452/323/195A/506 of the IPC was registered against the present applicant. However, it is not disputed that the applicant is on bail in the aforesaid case.

The learned counsel appearing on behalf of the applicant submits that the applicant will shift his residence outside the vicinity of NCT of Delhi and will not approach the complainant in near future. The applicant will file his undertaking in the form of an affidavit and will tender the same at the time of tendering bail bonds.

Therefore, considering the overall facts and circumstances of the present case, this Court is inclined to grant bail to the applicant on his furnishing a personal bond in the sum of ₹10,000/- with one surety of the like amount, subject to the satisfaction of the learned Trial Court/Successor Court/Link Court/Duty Judge concerned, on the following terms and conditions:

ii) In case of change of residential address/contact details, the applicant shall promptly inform the same to the concerned Court and IO/SHO concerned.

iii) The applicant shall appear regularly before the learned Trial Court, unless exempted.

iv) The applicant shall not communicate with, or come into contact with the complainant or any of the prosecution witnesses, or tamper with the evidence of the case. 6.

Accordingly, the present bail application stands allowed and is disposed of.

It is, however, clarified that nothing expressed hereinabove shall tantamount to an expression of opinion on merits of the case. 8.
