Petitioner Bank i.e. Punjab and Sind Bank had filed a suit seeking recovery.

Right to file written statement stood elapsed and since no written statement was filed, the right of the defendants to file written statement was also closed.

However, when such suit was taken up by the learned District Judge (Commercial Court) on 12.04.2023, it noticed that the plaintiff was seeking 18% interest with monthly rest and it was of the view that without any basis, a false statement had been made in the affidavit by the plaintiff-bank and chose to take action under Section 340 Cr.P.C.

Such order is under challenge.

However, learned counsel for petitioner-bank submits that thereafter, aforesaid case was transferred to some other Court and such suit is no longer pending adjudication, as it has already been disposed of and no further step is CM(M) 681/2023 1 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. being taken in terms of the aforesaid directions contained in order dated 12.04.2023. He submits that since suit has already been disposed of and no further action is contemplated or proposed against the plaintiff-bank, present petition has, virtually, become infructuous. He, therefore, submits that in view of the above, at the moment, petitioner-bank is no longer interested in pursuing with the present petition.

In view of the above, present petition stands disposed of as not pressed.
