This petition is filed on behalf of the Petitioner under Section 11(6) of the Arbitration and Conciliation Act, 1996 seeking appointment of Sole Arbitrator.

Learned counsel for the Respondents takes an objection to the maintainability of the petition on the ground that no document has been placed on record by the Petitioner which indicates the relationship between the Petitioner and M/s. A.B. Multiplex Pvt. Ltd. and there is no privity of contract between the Petitioner and the Respondents and consequently an arbitration agreement.

Counsel for the Petitioner, on instructions, seeks to withdraw this petition albeit denying the objection raised in light of letter dated 14.10.2014 written by M/s. A.B. Multiplex Pvt. Petitioner is an assign of the said firm. Liberty is sought to take recourse to appropriate proceedings with respect to the claims raised in the present petition.

This petition is disposed of as withdrawn with liberty to the Petitioner to take recourse to appropriate remedy making it clear that this Court has not expressed any opinion on the merits of the case. All rights and contentions of the parties are left open.
