This petition has been filed challenging the Order dated 18.03.2024 passed in Application No.227/2024, titled 'K. C. Mittal v. Shashi Sharma, by the learned Additional Sessions Judge/Special Judge NDPS, West District, Tis Hazari Courts (hereinafter referred to as 'Trial Court'), cancelling the anticipatory bail granted to the petitioner vide Order dated 09.11.2023 passed in Bail Application No. 3215/2023 by the learned Additional Sessions Judge NDPS, West, Tis Hazari Courts, Delhi.

petitioner herein is that the petitioner had failed to comply with the terms of the settlement agreement on the basis whereof the anticipatory bail had been granted to the petitioner. 4.

The learned counsel for the petitioner submits that the petitioner has now fully paid the settlement amount, in fact, in advance. The said fact is not disputed by the leaned counsel for the respondent no.2, who appears on advance notice of this petition.

As the petitioner has now duly complied with the terms of the settlement agreement, and also having perused the contents of the settlement agreement, in my opinion, the Impugned Order dated 18.03.2024 deserves to be set aside. Accordingly, the Order dated 18.03.2024 is set aside.

The petitioner shall continue to be released on anticipatory bail in terms of the Order dated 09.11.2023 passed by the learned Trial Court.
