This is a suit filed under Sections 134 & 135 of the Trade Marks Act, 1999, for permanent injunction against infringement of trade mark, passing off, unfair competition, rendition of accounts, damages and delivery up. 2.

The present suit has been instituted on account of the plaintiff being aggrieved by the defendant's use of the mark 'SOUTHERN INFOSYS' as a trademark/name, which is identical to the plaintiff's trademark/name and house mark 'INFOSYS'.

Learned counsel for the defendant states that the defendant's representative Mr. Siddharth Sharma, had duly appeared before the learned Joint Registrar (J) on 18.12.2025 and stated that the defendant is willing to suffer a decree of permanent injunction.

He states that a decree of permanent injunction may be passed in terms of prayers at paragraph 38(a), 38(b) and 38(c) of the plaint. 4.

Learned counsel for the plaintiff states that in view of the aforesaid submissions of the defendant and its action of changing its trade name to 'Southern Infoconsultants Ltd.', the plaintiff is not pressing for its remaining reliefs and will be satisfied with the relief of permanent injunction. 5.

In view of the aforesaid no contest between the parties, the relief of permanent injunction in terms of paragraph 38(a), 38(b) and 38(c) is hereby passed in favour of the plaintiff and against the defendant. 6.

The registry is directed to draw up a decree in terms of the aforesaid. 7.

The suit stands disposed of.

Pending applications, if any, stand disposed of. 9.

All future dates stand cancelled.
