The present petition has been filed for directions to the respondent to install the meter and restore the electricity of CA No. 153950566, installed at Property No. L-23 and L-24, Upper Ground Floor, Block-L, Mohan Garden, Uttam Nagar, Delhi - 110038.

Learned counsel appearing for the petitioners submits that the petitioners are lawful occupants of the upper ground floor of the property in question.

It is submitted that the electricity meter is registered in the name of mother of petitioner no. 1.

Electricity bill of CA No. 153950566 has also been attached along with the present petition.

It is submitted that on 22nd January, 2025, certain anti-social elements unlawfully stole the electricity meter, thereby, disrupting the power supply to the petitioner's premises. Immediately, thereafter, a Lost Article Report was lodged by the petitioner with the Crime Branch of Delhi Police. However, no action has been taken to trace the culprits. 7.

It is submitted that the petitioners also approached the BSES officials, i.e., the respondent herein. However, despite the petitioners approaching the official of the BSES, no action for installation of new meter has been taken up by the respondent-BSES Rajdhani Power Limited. 8.

It is submitted that the petitioner no. 2, who is the husband of petitioner no. 1, is suffering from various health conditions, due to which it is necessary that electricity connection is restored at the earliest, as the various medicines which the respondent no. 2 is required to take, are required to be refrigerated.

Issue notice. Notice is accepted by learned counsel appearing for the respondent, who submits that in the absence of No Objection Certificate ("NOC") from the registered owner of the property in question, a fresh meter has not been given.

At this stage, learned counsel appearing for the petitioners admits the fact that the property in question is registered in the name of mother of petitioner no. 1.

However, he submits that owing to certain personal disputes between the parties, the petitioner no. 1 is not in talking terms with her mother. The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

Considering the submissions made before this Court, it is directed as follows:

I.

A new electricity meter shall be installed by the respondent forthwith, with respect to CA No. 153950566, at upper ground floor of property no. L23 and L-24, Block-L, Mohan Garden, Uttam Nagar, Delhi - 110038. II.

The respondent shall not insist on any NOC from the registered owner of the property in question.

III.

The petitioners shall comply with all other codal and commercial formality for grant of a new connection.

IV. The petitioners will pay the arrears of consumption charges, if any, as demanded by the respondent.

V.

The petitioners will pay the current consumption charges in accordance with the bills raised by the respondent, from month to month. VI.

Respondent will be entitled to disconnect the electricity in the event of non-compliance with any of the above conditions. 13.

The present order has been passed without commenting on the status of the occupation of the petitioners and without going into the issue as regards the ownership of the property in question. 14.

It is clarified that the present order is without prejudice to the rights and contentions of the parties in any civil proceedings. 15.

It is further clarified that the mere fact that this Court has allowed the installation of a new electric meter, without NOC from the registered owner of the property, confers no equity in favour of the petitioners or any right as regards ownership, title or possessory rights of the property in question. 16.

Accordingly, the petitioners are directed to apply to the respondent for restoration of the earlier electricity connection by way of installation of a new electricity meter, within a period of one week from today. 18.

Upon receipt of the application, within one week thereafter, the respondent shall install a new electricity meter. 19.

The present petition, along with the pending applications, stands disposed of.
