This is a joint application filed under Order XXIII Rule 3 read with Section 151 of the Code of Civil Procedure, 1908 ['CPC'] for recording of settlement between the parties.

The terms of the settlement are recorded in paragraph 3 of the application.
The application has been signed by the authorized representatives of the plaintiff and the proprietor of the defendant. The application is also supported by affidavits of authorized representatives of the plaintiff and the defendant.

I have perused the terms of the settlement and do not find anything unlawful therein.

Accordingly, the present application is allowed CS(COMM) 258/2024 and I.A. 6833/2024 (O-XXXIX Rules 1 & 2 of CPC) 6.
In view of the order passed above, the present suit is decreed in terms of the settlement arrived at between the parties. 7.
I.A. 41104/2024 shall form part of the decree to be drawn up. 8.
Decree sheet shall be drawn up accordingly 9.
Since the matter has been settled at very initial stages, the Registry is directed to issue a certificate of refund the entire fees court fees in favour of the Plaintiff, in terms of Section 16 of the Court Fees Act, 1870.
