The present execution petition has been filed by Judgment Debtor No.2 seeking execution of the decree dated 12.12.2011 which was passed in terms of the Mediation Settlement Agreement dated 24.11.2011. 2.

The Decree Holder (Ram Sharma), who has joined through VC submits that the parties have already taken possession of their respective portions and the plot measuring - 34 ft x 40 ft at RZ- F1/3A, Nasirpur Road, Mahavir Enclave, Palam, New Delh -110045 (North-10 ft Road, SouthCommon Passage & Other's Property, East- Ram Sharma's Open Plot and West- Mr. Ashok Sharma's Open Plot) as stated in the Settlement Agreement dated 24.11.2021 has fallen to the share of the judgment debtor no.2/petitioner (Shyam Sharma).

The Decree Holder / Ram Sharma further states that he has no intention of creating any obstruction in the use of aforesaid plot by the judgment debtor no.2 (Shyam Sharma). In view of the above statement, the learned counsel for the judgment debtor no.2/petitioner does not wish to press the present execution petition. 5.

The petition is disposed of along with pending application, as not pressed.
