This is a petition filed under Section 29A (4) of the Arbitration and Conciliation Act, 1996, seeking extension of the mandate of the Arbitral Tribunal by a period of six months for concluding the arbitral proceeding and making the arbitral award.

Mr. Kapoor, learned counsel appears for the respondent and has handed over a copy of the reply. He states that in the present case, the mandate of the learned Arbitrator stood terminated on 07.11.2023 and there are no justifiable reasons for filing the present application after such a delay. 3.

It is stated that in the present case, after the mandate of the Arbitral Tribunal expired on 07.11.2023, the parties were in Mediation for some period of time. However, the mediation proceedings failed. the mandate. Neither the petitioner, nor the respondent objected to the same and in fact, participated out of their own free will. 4.

I am of the view that the parties have invested substantial amount of time, effort, energy and resources in the arbitration proceedings and changing the Arbitrator, at this stage, would be a waste of all the said resources. 5.

I am satisfied that sufficient cause has been shown for the delay. 6.

In this view of the matter, the mandate of the Arbitral Tribunal is extended by a period of six months from today to conclude the arbitral proceeding and to make the arbitral award.

The period from 07.11.2023 till today stands regularised. 8.

The petition is disposed of accordingly.
