The instant petition under Section 482 of the Code of Criminal Procedure, 1973 („Cr.P.C.‟) has been filed on behalf of petitioner seeking quashing of FIR bearing no. 114/2023, registered at Police Station Punjabi Bagh, Delhi for offences punishable under Sections 420/34 of the Indian Penal Code, 1860 („IPC‟) and all consequential proceedings emanating therefrom.

Issue notice. Mr. Manoj Pant, learned APP accepts notice on behalf of State.

The petitioner is present before this Court and has been identified by her counsel and Investigating Officer (IO) SI Mandeep Kumar, P.S.: Punjabi Bagh.

Brief facts of the present case are that on 31.12.2022, the petitioner‟s husband had filed a complaint against the complainant for blackmailing, abusing and threatening the family members of the petitioner. On 07.03.2023, the said FIR bearing no. 114/2023, registered at Police Station Punjabi Bagh, Delhi for offences punishable under Sections 420/34 of the IPC got registered against the petitioner. It is also stated that despite receiving various cheques delivered by the firm of the petitioner on various occasions through courier, the complainant never bothered to deposit cheques in the bank and had directly filed the FIR with baseless allegations.

It is further stated that the complainant has made a fabricated story that he had enquired in the bank of the Petitioner about insufficient amount in their bank accounts which does not hold any ground since the letter issued by the concerned bank clearly reflects as many as 13 accounts of the Petitioner‟s husband being operated satisfactorily with an amount of approximately more than Rs. 2 crores in those accounts. It is further submitted that the bank has never given any private information pertaining to the bank account of the Petitioner and her husband to any third person. 5.

On a query made by this Court, respondent no.2 who has been identified by the IO, has categorically stated that he had entered into compromise out of his own free will and without any pressure, coercion or threat. It is also stated by respondent no.2 that the entire dispute has been amicably settled between the parties.

Today, the complainant who is present in Court states that he has received the amount of Rs. 40,00,000/- vide DD No. 271413002078 and Rs. 2,00,000/- vide DD No. 271413002079 (Rupees Forty Two Lakhs in total) today, i.e., 18.03.2024 drawn on HDFC Bank, and has no objection if the The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

FIR is quashed.

In view of the above fact that the parties have amicably resolved their differences of their own free will, and without any coercion, no useful purpose will be served by continuing the proceedings, rather the same would create further acrimony between them. It would thus be in interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto. There is no legal impediment in quashing the FIR in question. 8.

Accordingly, FIR 114/2023, registered at Police Station Punjabi Bagh, Delhi for offences punishable under Sections 420/34 of the IPC and all consequential proceedings emanating therefrom are quashed. 9.

The petition stands disposed of. Pending application also stands disposed of.
