The Criminal Revision Petitions under Sections 438/42 read with Section 528 of The Bhartiya Nagrik Suraksha Sanhita, 2023 read with Sections 397/401 read with Section 482 Cr.P.C. have been filed by the Petitioner seeking setting aside of Order dated 28.01.2025 passed by the learned Trial Court whereby Petitioner has been directed to deposit 20% of the compensation/ fine amount within 60 days from the date of the impugned Order.

Vide impugned Order, the Petitioner has been directed to deposit 20% of the fine amount, which includes interest @9% P.A. It is submitted that because of financial difficulty, the Petitioner is not in a position to deposit the amount and a prayer is made that the amount for payment be reduced. 3.

Considering the submissions made and in light of the Judgment of the Apex Court in Muskan Enterprises and Anr. vs. The State of Punjab & Anr. (2024) INSC 1046, the impugned Order is hereby modified to the extent that Petitioner is directed to deposit 20% of the cheque amount within seven days.
