Petitioner herein is defending a suit for damages and defamation on account of alleged malicious prosecution.

At the very outset, Mr. Satish Aggarwala, learned counsel for petitioner states that the present petition has become infructuous since the suit as such has been held to be barred by time by the Hon'ble Supreme Court vide judgment dated 16.07.2024 passed in Civil Appeal No. 7808/2024, a copy of which has also been placed on record.

Since, the suit as such has already been held to be not maintainable and barred by time, nothing survives in the present petition and, therefore, the present petition also stands dismissed, as having become infructuous.
