Learned counsel for the petitioner seeks to withdraw the present petition inasmuch as the petitioner has availed the remedy of pursuing arbitration proceedings against the respondent no.1. 2.

In the circumstances, without commenting on the merits or maintainability of the said arbitration proceedings, the present petition is dismissed as withdrawn.

At the request of learned counsel for the petitioner, it is clarified that the withdrawal of the petition shall not preclude the petitioner from raising appropriate pleas in any arbitration/ civil proceedings.
