This hearing has been done through hybrid mode. 2.

The present petition has been filed, inter alia, seeking substitution of the Petitioner's name in place of his deceased wife in respect of the subject vending site.

The Petitioner is stated to be the husband of Smt. Morbai, who was a vendor on the left side of Shop No.96, Gate no. 1 Sarojini Nagar Market, New Delhi-11 0023. It is the case of the Petitioner that he and his wife used to vend together at the said site.

A Certificate of Vending bearing No. V2025601789 was issued to his wife under the category of "water bottle". The same has been placed on record. The Certificate of Vending reflects the Petitioner as the husband of the certificate holder - Smt. Morbai 5.

Further, the photographs of the subject vending site have also been placed on record and the same have been perused by the Court. 6.

The case of the Petitioner is that his wife passed away on 16th November, The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. The Order is downloaded from the DHC Server on 11/05/2026 at 13:15:15

2025 and in respect of the same the death certificate of the wife has been placed on record. Accordingly, it is prayed that his name be substituted in respect of the subject vending site and the Petitioner may be permitted to vend in place of his wife.

Ld. Counsel for the Respondent submits that the provisional Certificate of Vending has been issued, however, the final Certificate of Vending is under consideration before the Town Vending Committee-2, which is likely to finalise the list of approved vendors shortly.

Considering these facts and circumstances, the following directions are issued:- i) The Petitioner shall strictly comply with the terms and conditions of the Certificate of Vending.

ii) He shall not increase the space of his vending site beyond what is permissible as per the provisional Certificate of Vending. iii) Petitioner shall only be permitted to vend in the place of his wife for the period till when the provisional COV is valid. iv) The above shall be subject to any decision taken by the Town Vending Committee-2 in respect of the final list of approved vendors. 9.

Subject to the above, the Petitioner shall not be disturbed from peacefully vending.

Petition is disposed of. All pending applications, if any, are also disposed of.
