CORAM:

HON'BLE MR. JUSTICE NAVIN CHAWLA

O R D E R

% 12.03.2020 These petitions have been filed by the petitioner(s) inter alia praying for a direction to the respondent nos.1 and 2 to complete the process of allotment of land pursuant to the E-tender dated 04.02.2020, wherein the petitioner(s) claim to be H-I. The learned counsel for the respondents, who appears on advance notice, submits that the final decision on the tender is being processed.

In view of the above, the present petition(s) are premature and are disposed of directing the respondents to expedite the decision on the Tender.

The learned senior counsel for the petitioner(s) submits that in the previous tender also, the respondents had delayed taking a decision on the E-tender, forcing the petitioner(s) to file petitions

before this Court, including WP(C) No.2164/2018 titled Kawatra Tent and Caterers Pvt. Ltd. vs. The Director (R P Cell) Delhi Urban Shelter Improvement Board & Anr. In the said petition, this Court by an interim order dated 08.03.2018 had directed the respondents to maintain status quo qua possession of the subject property. I have perused the said order.

The said order was passed on the submission of the petitioner(s) that the possession of land in question was being taken over by the respondents without finalizing the tender. Such submissions are lacking in the present petitions. Incase the respondents do not finalize the tender but seek possession of the land back from the petitioner(s), the petitioner(s) would always be at liberty to take appropriate recourse to remedies open to the petitioner(s) in law.

Dasti.
