Applicant seeks regular bail in case arising out from FIR/File no. DGGI/INV/GST/2284/2023/Gr-C registered at DGGI, DZU for commission of offences under Section 132(1)(a) and 132(1)(b) of the Central Goods and Services Tax Act, 2017.

The arrest memo on record indicates that the petitioner was arrested on 24.02.2026 and is in judicial custody since then. 3.

Keeping in mind the involvement and magnitude of the alleged evasion of GST, the learned Senior Standing counsel for respondent, who appears on advance notice, in all fairness, admits that the maximum imprisonment would be of five years and the statutory period for filing complaint would be of sixty days. multiple firms, it may not be possible for Investigating Agency to submit the complaint within the stipulated period of sixty days i.e. by 25.04.2026. 4.

Learned Senior Counsel for the petitioner submits that, in view of the above, even otherwise, the petitioner would become entitled to be released on statutory bail.

When asked, learned senior counsel for the petitioner, on instructions, submits that there is no prior involvement of any nature whatsoever of the applicant in any other matter.

Keeping in mind the overall facts, clean antecedents and no likelihood of filing of complaint in stipulated period, albeit, without expressing any opinion over merits of the case, the applicant is directed to be released on bail, on his furnishing personal bond of Rs. 5,00,000/- with two sureties of like amount, to the satisfaction of the learned Trial Court/Link Court, further subject to following conditions:- i.

The applicant shall not leave India without prior permission of the learned Trial Court.

ii.

The applicant shall intimate the learned Trial Court by way of an affidavit and to the Investigating Officer regarding any change in his residential address.

iii.

The applicant shall appear before the learned Trial Court as and when the matter is taken up for hearing.

iv.

The applicant is directed to give his mobile number to the Investigating Officer and keep it operational, at all times. v.

The applicant shall not, directly or indirectly, tamper with evidence or try to influence the witness in any manner.

Pending applications, if any, also stand disposed of. 9.

Copy of the order be sent to the concerned Jail Superintendent for necessary information and compliance.
