% 23.02.2018 I.A. No. 2612/2018 (under Order 23 Rule 3 CPC, filed by the parties) and CS(OS) 980/2004 1.

This is a joint application filed by the parties under Order 23 Rule 3 CPC. The application is signed by the parties as also their counsels. This application satisfies the requirements of Order 23 Rule 3 CPC. 2.

In terms of the settlement agreement between the parties plaintiff gives up its right for specific performance and plaintiff has received a total sum of Rs.1,35,00,000/- from the defendants in the suit in full and final satisfaction of all the claims of the plaintiff in the suit. This amount is paid in terms of cheques as stated at internal pages 4 and 5 of this application. It is undertaken that these cheques will be honoured on presentation. CS(OS) 980/2004

Suit is accordingly disposed of as compromised and also disputes and claims being satisfied as per the terms as stated in the present application, subject of course to encashment of the cheques. Parties are left to bear their own costs.
