The present petition has been filed seeking following relief: "A. Set-aside and Quash the 2nd Supplementary Criminal Complaint dt. 22.11.2021 filed by the Respondent Agency in the matter of Directorate of Enforcement v. M/s. Moser Baer India Pvt. Ltd. (C.T. Case No. 75/2019) against the Petitioner.

B. Set-aside and Quash the Summons dt. 11.07.2022 issued under Section 68 of the Code of Criminal Procedure, 1973 by Ld. Special Judge (PC Act) CBI-18, Rouse Avenue Courts, New Delhi vide Order dt. 11.07.2022 passed in the matter of Directorate of Enforcement v. M/s. Moser Baer India Pvt. Ltd. (C.T. Case No. 75/2019)."

Mr. Ravi Prakash, learned senior counsel appearing on behalf of the petitioner, as well as, Mr. Vivek Gurnani, learned counsel appearing on behalf of the respondent/ED are ad idem that the present petitioner has been discharged of the offence under the PMLA, 2002. 3.

In view of the above development, Mr. Prakash seeks to withdraw the present petition and approach the Special Court for his further remedy in accordance with law.

The petition alongwith pending applications is dismissed as withdrawn.

Needless to say all the contentions available to the respondent/ED under the law shall remain open.
