The present writ petition has been filed with respect to unauthorized construction existing in the property measuring 200 sq. yards, bearing no. F39, West Jawahar Park, Laxmi Nagar, Delhi-110092, belonging to respondent no. 3.

It is the case of the petitioner that the petitioner had earlier filed a writ petition, being W.P.(C) 12833/2024, titled as Sh. Ali Rja versus MCD and Anr., before this Court, wherein, directions were issued to the petitioner to provide appropriate details of the property in question to the respondentMunicipal Corporation of Delhi ("MCD"). The present writ petition has been filed as it is the case of the petitioner that the petitioner has made representation to the respondent no. 2, i.e., Special Task Force ("STF"), vide complaint letter dated 04th February, 2025, but no action has been taken by the respondent, till date. 4.
Responding to the present petition, learned counsel for respondent no.1-MCD submits that, pursuant to the complaint received from the petitioner, the officers of the MCD tried to contact the petitioner on the phone number, as given in the complaint. However, he submits that the phone number of the petitioner, as given in the complaint, is not correct. He further submits that even the phone number of the owner/occupier of the building in question, is totally incorrect.

It is further submitted that the photographs, attached to the present petition, do not pertain to the property bearing no. F-39, West Jawahar Park, Laxmi Nagar, Delhi-110092.

He has shown the actual photographs of the said property and submits that the photographs attached to the present petition, are completely different and do not pertain to the said property.

Learned counsel for the petitioner submits that the petitioner shall cooperate with the MCD and approach the concerned officers of the MCD and point out the location of the property in question, wherein, the unauthorized construction exists.

Accordingly, the petitioner is directed to visit the office of the Executive Engineer, Shahdara, South Zone, MCD, Mr. Gagan Khanna, Mob: 9717787916, on 28th March, 2025 at 11:00 AM. 9.
The petitioner is directed to carry his original Aadhaar Card and other identity proof at the time of visiting the office of the MCD. The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

Upon the petitioner visiting the aforesaid officer, the location of the property in question shall be identified by the petitioner, as well as the officers of the MCD, and requisite action, as per law, shall be taken accordingly.

It is to be noted that vide order dated 12th September, 2024, this Court has already directed the petitioner herein, to assist the MCD in locating the property in question.
