The petition is for the following reliefs:

"(a) Issue an appropriate writ, order or direction, more particularly in the nature of mandamus, directing theRespondents to permit Petitioner No. I to appear through video conferencing/ virtual mode before the competent marriage registration authority/SDM for the purpose of marriage registration;

(b) Issue an appropriate writ, order or direction directing the Respondents to process and register the marriage of the Petitioners expeditiously on the basis of the marriage certificate and other supporting documents already available on record, without insisting upon the physical appearance of Petitioner No. I in India, subject to such verification as ~y be deemed appropriate;

( c) Issue an appropriate writ, order or direction directing the Respondents to decide the Petitioners' representation/ application seeking virtual appearance within a time-bound period;" 2.

The petitioners are wife and husband respectively. They submit that their marriage was solemnized on 14.09.2024 according to Sikh rites and ceremonies at Sri Guru Singh Sabha, C-Block, Naraina Vihar, New Delhi. The necessary certificates have been issued by the concerned Gurudwara. The petitioner no. 1 is residing abroad in Canada and is in an advanced stage of pregnancy (35 Weeks). The expected dated of delivery is 12.05.2026. She is therefore unable to travel to India for the limited purpose of personal appearance before the respondent No. 2.

The petitioner No. 2 is also unable to travel due to non- issuance of spousal visa which could only be issued once the marriage between the petitioners gets registered.

Having considered the overall facts and situation and in view of the directions already passed by this Court in similar circumstances, the Court finds that the instant petition should be disposed of and is, accordingly, disposed of with the following directions:

(i) Let petitioner no.2 to appear physically before the concerned Authority. Let him also produce the affidavit of authority on behalf of petitioner no.1. He shall produce all necessary documents before the concerned Authority.

(ii) Let the petitioner no.1 be permitted to appear before respondent no.2 through video conferencing (VC). Let the same permission be granted by the concerned Sub-Divisional Magistrate (SDM) subject to convenience of his office as well as petitioner no.1. (iii) Let the two witnesses to also appear in person before the concerned SDM to verify the signatures and other formalities being carried out by petitioner no.1. The two witnesses shall be in addition to petitioner no.2. Let those witnesses to also identify petitioner no.1's presence through VC.

(iv) Let the petitioner's application be considered expeditiously and The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
