A perusal of the record reflects that the candidature of the Petitioner for the post of Head Constable (Ministerial) has been rejected after declaring him medically unfit. 2.

Learned counsel representing the Petitioner contends that the Respondents had referred the Petitioner to Care Hospital at Nampally, Hyderabad where a Specialist Doctor, after examining the Petitioner, diagnosed that the Petitioner is 'normal' and fit to join. Learned counsel further contends that the Respondents have erred in failing to follow the procedure/guidelines laid down in this regard. 3.

In the present case, the career of a young man is at stake. 4.

Accordingly, in view of the peculiar facts of the case, this Court considers it appropriate to direct the Petitioner to appear before the Army Hospital Research and Referral Hospital, Delhi ('R&R Hospital').

If the Petitioner is found medically fit by R&R Hospital, the Respondents shall forthwith appoint the Petitioner and in case the medical opinion by the said Hospital goes against the Petitioner, the said conclusion shall be accepted by the Petitioner and the matter will stand closed. Let this exercise be undertaken within a period of one month from today.

A copy of this order shall be communicated to the Director/Registrar, R&R Hospital, for compliance. 7.

The present petition is disposed of in the aforesaid terms.
