This is a writ petition filed under Article 226 of the Constitution of India, 1950 seeking a direction to respondent No.1 to provide electricity connection at the third floor of Property bearing No. E-66, Mansarovar Garden, Delhi-110015.

various inhabitants of the aforesaid property on the ground floor as well as to the first floor, however, despite the application filed by the petitioner seeking electricity connection to the third floor of the same property, the same was rejected by the respondent No.1 on the ground that separate dwelling unit was not found.

Issue Notice.

Notice is accepted by Mr. Manish Srivastava, learned counsel appearing for the respondent No.1. He submits that since the petitioner is already availing supply of electricity through the connection given to one of the neighbours, the respondent is unable to furnish a fresh meter in respect thereto. He further submits that, in case, the petitioner is willing to disconnect the said connection, the respondent No.1 would have no objection or impediment in furnishing fresh electricity connection through an electric meter, subject to the fulfilment of the commercial formalities.

Learned counsel for the petitioner, on instruction, submits that the petitioner is willing to do so and will give an undertaking by 29.03.2024.

Learned counsel for respondent No.1 submits that on a receipt of such undertaking and subject to fulfilment of commercial formalities, the electric connection shall forthwith be granted to the petitioner.

In view of the aforesaid statements of the parties, the present petition along with pending application stands disposed of.
