The present writ petition has been filed seeking a direction to the respondent no.1/ MCD to inspect the unauthorized construction being carried out by the respondent no.2 at Property Bearing Number L-37 and L38, Gali No. 2, Meenakshi Garden, New Tilak Nagar, New Delhi-110018 (hereinafter the 'subject premises') and take appropriate action in respect of the same.

Counsel appears on behalf of the respondent no.2, on advance notice, and questions the locus of the petitioner Association to file the writ petition. 4.

He submits that the petitioner Association is located nowhere next to the property of the respondent no. 2, and hence does not have the locus to file the present writ petition.

Taking into account the aforesaid submissions, the present writ petition is disposed of, while directing the respondent no.1/ MCD to inspect the subject premises and take appropriate action, in accordance with law. 6.

All rights, contentions and legal remedies of the private respondent no. 2 are kept open.
