The petition is for the following reliefs:
"a) issue an appropriate Writ, direction or order in the nature of certiorari for quashing letter No. 54(2786) / North Roads Division, P. W.D. Roads/ N.R 12/1153 dated06.04.2026 (AnnexureP-1) b) issue an appropriate Writ, direction or order in the nature of mandamus directing the Respondent to return Rs. 54,38,526.00 deposited by it in respect of Tender ID 2026_PWD_286563_1;" 2.
The grievance of the petitioner is with respect to the forfeiture of the entire earnest money which was submitted pursuant to tender process initiated by respondent for Remodelling of storm water as per New Master Drainage Plan 2025 from Camp Chowk to Azadpur H-Point on Mall Road under Sub Division No. NR-12 of North Roads.

typographical error, which had occurred unintentionally, the petitioner's entire earnest money may not be forfeited.

The submissions are strongly opposed by learned counsel who appears for respondent on advance copy.

The Court, however, finds that as per Clause 18 of the Standard Operating Procedure issued by the Central Public Works Department, the respondent would be entitled to forfeit 100 per cent of the earnest money in case of certain circumstances.

The assertion of the petitioner that it was bona fide error and was unintentional. The same can be looked into by the concerned Department. If the concerned Department is satisfied with the submission, it shall consider to proportionately reducing the extent of the forfeiture of the earnest money. 7.
The aforesaid would be the discretion of the concerned Department and shall depend upon the various facts and circumstances. 8.
Accordingly, let this petition be treated to be a representation by the concerned Department. Let the Department to deal with the same within a period of two months from the date of receipt of a copy of this petition along with a copy of this order.

With the aforesaid directions, the petition, along with pending application, stands disposed of.

If the petitioner has any further grievance, thereafter, it shall be at liberty to take appropriate recourse in accordance with law.
