An application under Section 439 read with Section 482 of the Code of Criminal Procedure, 1973 ('Cr.P.C.') has been preferred on behalf of the petitioner for grant of regular bail in FIR No. 0467/2022 under Section 307 IPC registered at P.S.: Ambedkar Nagar.

In brief, as per the case of prosecution, on 06.09.2022, a stab injury was inflicted by the petitioner with a knife on the vital part of the victim over a minor issue.

Learned counsel for the petitioner submits that the petitioner is in custody since 07.09.2022 and was aged just above 18 years at the relevant time. It is also urged that petitioner has clean past antecedents. 4.

On the other hand, learned APP for the State opposes the application and submits that the nature of injury is grievous which was inflicted on the vital part of the body.

I have given considered thought to the contentions raised. Admittedly, the case is still at the stage of charge and the conclusion of trial is likely to take considerable time. It cannot be ignored that the petitioner was aged just above 18 years at the time of incident and has clean past antecedents.

Considering the facts and circumstances, petitioner is admitted to bail on furnishing personal bond in the sum of Rs. 20,000/- (Rupees Twenty Thousand only) with one surety in the like amount to the satisfaction of the learned trial court and subject to the following conditions: (i) Petitioner shall provide his mobile number to the Investigating Officer (IO) / SHO concerned;

(ii) In case of change of address, petitioner shall intimate/communicate his address to the IO/SHO concerned; (iii) Petitioner shall not threaten or influence the witnesses in any manner.

Application is accordingly disposed of.

A copy of this order be sent to the Superintendent Jail and learned Trial Court for information.
