This appeal has been filed challenging the order dated 20.03.2026 passed by the learned Single Judge on an application filed by the respondent under Order XXXIX Rules 1 & 2 of CPC, 1908 in CS(COMM) 280/2026. 2.

Mr. Rajiv Nayyar submits that as the impugned order has been passed without notice to the appellant herein, he is agreeable on the impugned order being kept in abeyance till the learned Single Judge decides the application afresh.

Mr.Sandeep Sethi, is also agreeable to the submission made by Mr.Nayyar.
