Writ Petition under Article 226 of the Constitution of India read with Section 482 Cr.P.C. has been filed on behalf of the Petitioners seeking quashing of FIR No.0368/2023 dated 17.03.2023 under Sections 420/467/468/471/120B/34 IPC, registered at PS: Shahbad Dairy, Delhi, in terms of Compromise Deed dated 26.09.2023.

The dispute in present case arose in respect of possession of immovable property, documents of which were in the possession of the Petitioners, but Respondent No.2 has alleged them to be forged and fabricate.

The matter has now been settled vide Compromise Deed dated 26.09.2023 and Petitioners have withdrawn Civil Suit and the possession of the property shall continue to be with Resopndent No.2. The parties are present in the Court and have been identified by the I.O. The parties submit that they have arrived at the settlement without any force, coercion and undue influence and pressure and they have signed the Compromise Deed dated 26.09.2023 with their wish and will. 5.

Learned Counsel for Petitioners submits that the parties have no grievance against each other. Since Respondent No.2 has already made a statement before the Court that he does not want to pursue the proceedings in FIR, the present Petition be allowed and FIR No.0368/2023 be quashed. 6.

In view of Compromise Deed dated 26.09.2023, present Petition has been filed.

Respondent No.2 is present and submits that he has no grievance against the Petitioners and also no objection to the quashing of FIR. 8.

In view of the fact that the FIR in question was premised upon a dispute over possession of immovable property between the Petitioners and Respondent No.2, which has been amicably resolved in terms of Compromise Deed dated 26.09.2023. Considering the fact that Respondent No.2 has also given no objection to the quashing of FIR, no fruitful purpose would be served in continuing with the proceedings arising out of the FIR. 9.

Consequently, FIR No.0368/2023 dated 17.03.2023 under Sections 420/467/468/471/120B/34 IPC, registered at PS: Shahbad Dairy, Delhi and all consequential proceedings emanating therefrom are quashed. 10.
