The present appeal was adjourned sine die vide order dated 04.03.2014 with liberty granted to the parties to approach this Court after the Supreme Court decides the inter-se disputes.

Learned counsel for the parties jointly states that much water has flown under the bridge after 04.03.2014 inasmuch as the learned Single Judge in Suit No. 238/89 and Probate No. 19/97 and Probate No. 20/97 has passed a consent order on 01.08.2016, whereunder liberty has been given to the other side to cross examine the petitioner in Probate No. 19/97. 3.

Learned counsel for respondent nos. 2 to 5 submitted that pursuant thereto, a challenge laid by some intervenors, who had approached the Supreme Court by filing an SLP, has been withdrawn and they have been FAO(OS) 362/2000

impleaded in all the three cases which submission is denied by learned counsel for the appellant.
