% 20.01.2020 This matter was listed on 17.01.2020. On that date it was noted that the respondent SDMC has filed a status report according to which the property which is the subject matter of this writ petition, namely, plot No. 15/12 Sarvpriya Vihar, New Delhi has no unauthorised construction. It is stated in the status report that the property was built after online sanction of the building plan on 25.10.2017. A completion-cum-occupancy certificate has now been handed over on 01.04.2019.
However, on 17.01.2020, learned counsel for the petitioner had submitted that he has not received a copy of the status report. A copy of the report was handed over to the learned counsel for the petitioner to enable
him to take instructions and the matter was adjourned for today. Today, Mr. Anil Mehta, son of the petitioner is present in person and states that the counsel had to leave on account of some urgent reason. However, a reply to the status report is sought to be placed on record. The reply only states that copy of the sanctioned plan and NOC from ASI has not been supplied by respondent No.1 SDMC to the petitioner and in the absence of these required information, the petitioner is unable to file an effective reply. The reply of the petitioner is evasive. In my opinion, nothing further survives in this petition. The status report of respondent No. 1 clearly states that there is no unauthorised construction.
The petition accordingly stands disposed of. Pending application also stands disposed of.
