% 23.01.2018 Petitioner is 50 year old lady. She is seeking anticipatory bail. She is the mother-in-law of the deceased Kirti. Learned counsel for the petitioner points out that two other co-accused the father-in-law (Ram Kumar) and brother-in-law (Aman) have since been granted anticipatory bail. A detailed order had been passed on 15.01.2018 noting the facts of the case. Attention has been drawn to the said order.
The victim had succumbed her injuries in the matrimonial home. In the course of the statement which were recorded before the SDM, it has been reflected that the present petitioner on the fateful night had gone to the adjacent house of the family where the buffaloes of the family were tied; she had gone to look after them.
Learned counsel for the petitioner points out that in the statement of the parents of the victim recorded before the SDM the only role that was attributed was to the husband of the victim namely Vikas and no role had been attributed to the other family members including the present petitioner.
Without delving any further into the facts of the matter, this court is of the view that noting the allegations in the FIR and the statement of the parents of the victim which was largely bordered against the role of the Vikas (husband of the victim) and on the undertaking that the petitioner shall join investigation as and when summoned by the investigating officer, in the event of arrest the petitioner be admitted to bail on furnishing of a personal bond in the sum of Rs 10,000/- with one surety of the like amount to the satisfaction of the SHO concerned.
Petition disposed of.
